In Callahan v Kevin Ransom, #20-01824, the Honorable Scott Reid of the Federal Court for the Eastern District of Pennsylvania placed a stay on the matter of Callahan v Ransome et.al, so Mr. Callahan can litigate his newly discovered DNA evidence in a second state P.C.R.A. see Commonwealth v Paul Callahan, #CP-09-CR-1168-2015
Mr. Callahan hired Legal-Eagles to reach out to Forensic Biologist and DNA technical leader, Katherine Cross at Guardian Technologies. Ms. Cross used to work for N.M.S labs who did the original testing on Mr. Callahans DNA.
N.M.S never conducted a standard STR test which would have conclusively identified the identity of the DNA. Instead, they performed a YSTR test which only can test for the family line and identity of the DNA to the exclusion of certain other categories and based on certain average percentages.
Legal-Eagles was also provided a 240 page commision investigation report from Ms. Cross, a report conducted against N.M.S which found incompetence among its staff and chronic misinterpretation of DNA mixtures. Since the report, N.M.
S no longer conducts DNA testing.
Legal-Eagles is hoping this new evidence will result in a new evidentiary hearing and trial for Mr. Callahan.
